  • Describe motions practice in your court. Are there any local practices that attorneys should be aware of? Magistrate Judge Baxter normally does not conduct oral argument on pretrial motions because she does not find it useful. She does require briefs to be filed in support of all motions, except for extensions of time and in prisoner cases. If no brief is filed, reasons for the relief sought should be stated in the motion. She will permit reply and surreply briefs, if they have something to add and are to the point. Magistrate Judge Baxter prefers not to receive copies of motions papers.
